State v Jamal Wade NJ Supreme Court 2021

Meg and Jeff Horn, Toms River family law attorney and host of The Bold Sidebar, continue their discussion of 2021 New Jersey Supreme Court decisions.

In October and November 2021, the New Jersey Supreme Court granted cert in two cases dealing with Miranda and the admissibility of a defendant’s statement to police.

In State v. Jamal Wade, the Court agreed to address the question of whether the defendant, who contends that he was not informed of the nature of the charges against him or that he was under arrest, knowingly and voluntarily waived his Miranda rights.

In State v. Abayuba-Rivas, the Court agreed to address the question of whether the suppression of the defendant’s statement to police due to a violation of his right to counsel requires the suppression of defendant’s later statement to the police made the following day.

Meg and Jeff discuss these relevant Miranda decisions and the Court’s willingness to grant cert to protect an individual from implicating himself when the police have violated his rights. If you enjoy NJ law podcasts… please rate and subscribe anywhere you listen.
